In 2017, we decided to help even more in Slovakia than before. As we do abroad, we want to address in particular causes of poverty and bringing long-term sustainable change for the better. In our several months of needs research, we found that people in Slovakia often find themselves in need because don't know their rights. And even if they know them, they do not have the financial means to avail themselves of legal services to help them. That's why we at ADRA Slovakia have launched a new project - Legal aid for people in need in Slovakia.

For people in material need, free legal aid from the Legal Aid Centre is primarily intended, but the law limits this aid to 1.4 times the amount of the minimum subsistence wage (EUR 277.33) and the value of the dispute must exceed the value of the minimum wage in Slovakia (EUR 435). However, there are those among us who urgently need legal advice, cannot afford to pay for it, but do not qualify for free legal advice from the CPP (because they have an income or pension of, for example, EUR 280 per month, i.e. more than the limit of the law). It is for these people that we are here and our lawyers Danka and Miška, to help them get out of problems that are related to our focus, such as family law, civil law, medical law or criminal law.

Our goal is, that all people in need in Slovakia, not just those who meet the constraints of the law, have access to quality legal aid. And that their financial situation should not be an obstacle to seeking justice that will change their lives for the better.

What areas of law do we primarily focus on?

 
  • Family Law:
 
- divorce, child custody (regulation of the exercise of parents' rights and obligations towards their children: entrustment to personal or alternate custody, regulation of parent-child contact, maintenance of the parent to the child, administration of the child's property), marriage (determination of nullity and non-existence of marriage, permission to marry), parental rights, types of child custody - substitute personal care, foster care, institutional care, guardianship and custody), maintenance obligations not only of parents towards children but also of spouses, divorced spouses, unmarried mothers and children towards parents and others, parenthood (determination, denial), adoption, change of name after divorce
 
- family law related children's rights, child abduction, extradition of children abroad, enforcement of decisions in juvenile matters
 
  • Issues of domestic and sexual violence:
 
- promoting victims' rights through legal aid, legal information and legal representation in criminal, civil or misdemeanour proceedings
 
  • Civil Law:
 
- rights in rem (ownership, co-ownership, joint and several property of spouses „BSM“, pledges, easements), liability for damages and unjust enrichment (compensation for damages, pecuniary and non-pecuniary damage), rights of obligations (liability for defects, acknowledgement of debt, settlement, set-off...), preparation and drafting of contracts (contract of sale, contract of gift, contract for work, etc...), limitation/deprivation of legal capacity, protection of personality (reputation, honour), inheritance proceedings
 
- we do not specialise in personal bankruptcy, in which case we recommend contacting the nearest Legal Aid Centre (CPP) or other approved institutions
 
  • Medical Law:
 
- protection and redress for healthcare negligence

Our free help is for people in need who do not have enough money for legal services and cannot afford to pay a lawyer. And also for people who do not qualify for free assistance in the CPP (because they have an income higher than 277,33 EUR). We assess each case individually.

Updated: Since the launch of free legal aid for people in need (in May 2017), we have provided legal advice to over 300 people and are representing 10 people in legal proceedings by the end of May 2018, i.e. in 1 year. Thank you for helping with us.
